You need to review your advertised rates to stay in compliance with insurance laws. This does not need to affect the rates you charge to your normal clients…just the way you word it on your advertising.

Different jurisdictions pay different amounts with the highest being federal workers comp at $200 per hour. Some of our out of state claims pay around $150 and in hawaii its $134. You are not allowed to charge different rates for the same service in different jurisdictions. So if you want the full amount for all jurisdictions you need to charge the maximum amount of $200 per hour.

Of course you don’t want to put off your regular clients by seeing this high rate on your advertising….so the best way to do that is to define different services and have a different rate for each. For example your published rate listing might be:

  • Accident rehabilitation $200/hr

  • Massage $100/hr

  • 20% discount for kama’aina

If a client is put off by the $200/hr accident rate. Let them know that the rate that is actually paid is determined by jurisdiction that their claim type falls under and will usually be less. Also that you can give them a discount if its not covered by insurance.
